    Content: As a busy professional I know your time is precious and so I will keep my message short and to the point. Chief among concerns for both Baby Boomers and Millennials is that they will outlive their retirement savings. It is (and should be) a very real concern for most individuals, as traditional retirement savings programs will not, in most cases, provide sufficient retirement income to live comfortably into our 80s, 90s, 100 and beyond. Given my own concerns, some years back I set out to find an alternative investment strategy because I too wasn’t pleased with the results of my 401(k) and other investments. The volatility of the market and the disappointing returns from my 401(k) plan (my research enabled me to learn why) drove me to explore all available options. My extensive research led to the discovery of a not-so-well-known life insurance policy called Indexed Universal Life (“IUL”). Being a passionate student and information sponge, I put forth the effort necessary to learn everything about IULs, and became so fascinated and intrigued, that I studied for and passed the insurance license exam (and eventually obtained an insurance agency license), as both afforded me the opportunity to gain even greater access to the inner-workings of IULs and a more in-depth understanding of them. I next researched the top insurance companies in the IUL space (and continue this research quarterly) and eventually became appointed by them. I’m so passionate and knowledgeable about the power of IULs, and so desirous of sharing my findings with others, that I routinely author articles and blogs, and also utilize Linkedin and other social media to help spread the word. Ask 5 of your friends or colleagues if they’ve heard of IUL. You’ll quickly learn that it is, sadly, among the best kept secrets in the financial world. I intend to change that. Like printers, the right IUL can be an all-in-one for protecting your family now, through your retirement years and even after your passing. My desire to be fully educated also led me to peel back the layers and understand why the results of my 401(k) plan were so dismal even after many years of plan participation. 401(k) plans came on the scenes in the early 80s as a means for allowing companies to stop offering and funding pension plans. 401(k) plans did not contemplate people living well into their 80s and beyond. With the continued advancements in medical science, many baby Boomers, Millennials and all generations that follow will likely live to 100 and beyond. I learned too that because 401(k) plans are at the mercy of the volatility of the stock market (dips result in losses), are subject to heavy fees (as much as 3% of the plan balance annually, regardless of the plan’s performance), and that eventually distributions will be treated as ordinary income, and so subject to income tax, I came to realize that 401(k) plans were really designed to only deliver retirement income into our 70s, maybe into our 80s if we’re frugal. Then what? Thankfully, the fix is easy if you take the right steps now and our practice can make it very easy for you.     Content: Just as all living things grow over time, so can your retirement savings. The simple rule is this: the sooner you start (ideally, as soon as your career begins), the more you contribute to the right type of investment over time, the sooner you can retire and the more you’ll have to live comfortably and enjoy during your retirement years. Sounds easy, but it requires know-how and due diligence on the investor’s part to identify the right type of investment, and a commitment early in life to begin and stay with the investment activity. For three-plus decades now, investors have placed much of their faith in 401(k) plans offered by their employers. As time goes on, those in the know have come to realize that 401(k) plans are anything but the retirement panacea they are touted to be. In fact, they represent a very lousy investment strategy as it relates to enabling investors to realize their retirement objectives, In fact it likely won’t even come close. Fast forward to today, and the many the deficiencies associated with 401(k) plans have surfaced, and in some cases, are serving as the reason for litigation against Plan Administrators for failure to fulfill their “fiduciary duty.” The Plan Administrator’s fiduciary duty includes, in part, ensuring that plan fees are reasonable, and that the investment funds offered are reasonably performing for their respective category (e.g., mid-cap, growth, etc.). Litigation is being pursued by both the Dept. of Labor (“DOL”) where participant complaints led to a review of the plan’s fees and performance, and by individual plan participants, often as a class-action lawsuit, alleging the same. And there are a growing number of these cases each month, with some resulting in very large awards being granted in favor of the plan participants and against the Plan Administrator and other parties connected to the administration of the 401(k) plan. Despite the awards, plan participants will generally still experience some level of loss. 401(k) Plan Deficiencies: 1) 401(k) plan fees can reach as much as 3% and are assessed annually, regardless of the plan’s performance that year. So a plan participant with $50,000 in plan assets can lose as much as $1,500 annually to fees, again, regardless of the plan’s performance that year. 2) Another shortcoming with 401(k) plans is that participant investments are subject to the volatility of the financial markets. Every time the markets dip (stock & bond) so do plan assets. And the only way to recover the losses is to experience a number of positive return years. The markets have been very volatile over the last several years, and those in the know, economists and other financial experts, predict more to come given our country’s (and others) growing debt and lessening credit standing. 3) The third challenge with 401(k) plans is that distributions, which can begin voluntarily at age 59.5 without penalty, and must begin by law at age 70.5, are subject to taxation and treated as ordinary, taxable income. It’s reasonable to believe that the US tax structure will change over time, and that all taxpayers will be paying higher taxes. It’s the only sure way the Federal Government can pay down the mounting debt. The sad reality for many 401(k) plan participants is that the combination of fees, losses due to market decline and taxation very often result in insufficient retirement funds and plan participants way outliving their money. Fear of losing money is a major reason people don’t invest. The recurring recent stock market plunges are the reason those in their 20s, 30s and 40s are too afraid to save in the market, despite the fact that historically, it has proven to be the best long-term place to save. However, qualified plans are a different story. TIME magazine devoted its Oct. 9, 2009 issue to “Why It’s Time to Retire the 401(k).””The ugly truth is that the 401(k) is a lousy idea, a financial flop, a rotten repository for our retirement reserves,” writes Stephen Gandel, a senior editor of Money magazine, in that issue of Time. The solution: a new type of insurance. Retirement savings, it turns out, are exactly the type of asset we need insurance for … to protect against the risks we can’t predict and can’t afford to recover from on our own. … Recent opinion polls show people would be willing to give up qualified plans for a guaranteed return.” But investors — and most financial advisors — have absolutely no idea that a tax-free, market risk-free, gains-locked-in, congressionally-approved solution has been sitting right under their noses for nearly 18 years. Indexed Universal Life’s (“IUL”) primary benefit is the fact that, like an indexed annuity (and unlike a mutual fund Roth), you keep all the gains and realize none of the market losses. But there are many more benefits included that no other investment can lawfully offer, except maybe a Roth.Every 401(k) Plan participant needs to ask themselves what is my “Plan B” for my 80s, 90s and beyond in terms of how will I support myself and others dependent upon me if I outlive my 401(k) plan retirement savings? Several things to consider: 1) If you do participate, do so only to the extent of receiving the full amount of your employer’s matching contribution. Plans differ, but it’s often something like $.50 on the dollar up to the first 6% of income the participant earns and contributes. So, in this example, the right strategy would be to participate only at the 6% level to obtain the employer’s full 3% matching contribution; 2) Ascertain the fee structure assessed by the plan and look for ways to reduce them by selecting good-performing funds with lower fees; 3) Regularly monitor your selected funds’ performance to ensure that they perform well in their respective category and have low fees. There are a number of rating companies with such information available on the Internet; and 4) Most importantly, diversify your investment strategy to ensure that your money outlives you. An alternative strategy: An alternative strategy, and the primary strategy we recommend to our clients, is to simultaneously invest in a life insurance policy called Indexed Universal Life (“IUL”). A carefully selected IUL can accomplish three very important strategies for the policy holder: 1) Provide a tax-free death benefit to care for loved-ones left behind or to create a legacy for older children and grandchildren; 2) Provide so called ‘living benefits” which provides tax-free cash in the event of chronic, critical or terminal illness (cancer, stroke, heart attack, etc.) to help cover both daily living expenses and unpaid medical bills (this feature alone will prevent the financial devastation that normally arises following a serious illness – 75% of individuals faced with serious illness end up bankrupt, and the living benefits component will also enable a policy holder to stop paying for other now unnecessary voluntary policies covering disability, cancer, critical illness, etc. – these dollars can be better invested into an IUL); and 3) Provide a sizeable amount of tax-free income during retirement that can be structured to be paid to the policy holder until at least age 100. IULs are also assessed fees, and can be less than 1% over the life of a properly selected IUL. “Indexed” IULs are tied to a financial index (e.g., S&P 500), and grow annually to a capped level (as high as 12-14% depending on the IUL) in up market years and don’t grow (but remain at 0% growth – the “floor” – vs a loss) in down years. IULS are not subject to the volatility of the financial markets in that they do not produce asset loses in years that the markets are down. For our clients not yet 59.5 years old (and who don’t meet the special circumstances outlined below) , we recommend opening an IUL account as soon as financially feasible, and funding it with at least a few hundred dollars per month, and more as it becomes affordable. As mentioned earlier, the longer one contributes to the right retirement savings program, and the more contributed, the greater the amount of money that will be available when it’s time to start receiving retirement income. As with any life insurance policy, the younger and healthier one is at the time the policy is issued the better the rating (standard, preferred, elite, etc.) and the lower the cost of the insurance coverage. For our clients who have achieved age 59.5, we recommend that they begin taking annual distributions from their 401(k) plan in an amount as advised by their tax preparer, and contribute that money into their IUL. And continue to do so until 401(k) plan assets have been fully distributed to them and contributed to their IUL. Special Circumstances Allow For Penalty-free Early Withdrawal: There is a not-so-widely-known provision within the Internal Revenue Code that allows for taking distributions from a 401(k) plan before reaching age 59½? This little-known section of the code, §72(t)(2)(A)(v), can be ideal for someone who happens to fit the requirements. The primary requirement is that you separate from service with the employer whose 401(k) plan you participated in at or after age 55. If a person is working for a company and participating in the company’s 401(k) plan, should leave employment with that company at any time during or after the year in which they reach age 55, there will be no penalty for taking distributions from the plan. Normally, any distribution prior to age 59½ will result in the 10% penalty being applied, in addition to the income tax due based on that year’s total earnings. It is important to note that these distributions only qualify when received from a company-established defined contribution plan, e.g., 401(k), 403(b), etc. – NOT an IRA account. In order to maintain this penalty-free distribution, the funds must not be rolled over into an IRA, but can be used for other purposes, including acquiring life insurance. This is a critical distinction that you need to understand – a mistake would disqualify the distribution and take away this option completely. Lastly, the Pension Protection Act of 2006 made one additional change to the code: The age limit is reduced to 50 for retiring law enforcement, firefighters,and medics. Retirees from those specific jobs can take a penalty-free distribution from their accounts when they leave employment at or after age 50. Retirement savings, when to start?
